yeah, your gear is actually pretty good outside of 3 items that are messing you up. First thing you should do is get a new ring... with hit or without hit, get a pve ring. You also need to change both of your trinkets. Granted, the pocketwatch isn't bad, you can easily get better from normal toc 5 man. Also, your over-hit is definitely from that hit trinket. It's not really meant as a high end trinket, but something to get people to the hit cap quickly when they have lower level gear (or just badge gear at least). Even replacing that with the dying curse will be better since DC gives far less hit but gives a better bonus otherwise.

Get the Emblems of Triumph ring. Gets rid of 50 Hit rating AND is a pure PvE ring. And has SP, Spirit and Haste, and especially your haste level is a bit low.
As already mentioned, replace Pocketwatch with the ToC5 normal trinket, same proc, but haste instead of crit.

You could drop some more hit by either getting bejeweled wizards bracers crafted or merlins robe, i would go for merlins robe imho, since its BiS till you hit ToC25 hc.

And your neck should be replaced asap, since its a wasrte of stats going with mp5. There is one neck for Conquest badges, grab it.

Dying Curse - Item - World of Warcraft would be a good option for you to replace your Shard with.

With the gear you have access to (ToC level), I would try to reach hit cap without using a trinket (although as Cormanthor has pointed out, Dying Curse may be an exception). In the short term, getting the badge ring is a good idea (that should put you much less out of whack with the cap). Also, what's with the neck?

Fixed the neck, i replaced with Evokers Charm. I just feel like an idiot wasting all those triumph badges on that hit trinket, when I should of saved them for something else. But I will collect more, and work on the suggestions everyone has proposed, thank you for the advice.

Why waste emblems on that when he could farm Abyssal Rune? He's well under 500 haste with more than 25% crit, he could use it....

Raiding with a spriest or boomkin and he's still over the hit cap replacing that hit trinket.

For that matter, and no one has mentioned it, he should have the spirit or speed enchant on his boots, not Icewalker. Right now it's just a 12 crit enchant, not worth much....
