Question between 44/18/0 and 40/21/0 build

I was trying to find a balanced build between PvP and PvE (for heroic instances and raids). This is my current lock build http://www.wowhead.com/?talent=IiMrVRfkqtRorxc0f (44/17/0)1It seems to do OK in both but nothing fantastic.

There is another lock in my guild that has http://www.wowhead.com/?talent=IiMMiRfzVtbZbtczIbz as build (40/21/0).

His build was able to outdo my damage output in instances (even with my few purples that I have and his all blues).

I have seen a few a lock like this running around in some BGs (at least up to the demonic sacrifice).

I was curious if it was worth to try switching over to something like that build or keep what I have and work on a better casting order to have a high damage output.

Any Ideas?
